The relook of the cases is triggered by the fact Sarma in August this year asked the police to relook in the minor girl child murder case in Darrang district and the case was handed over to Criminal Investigation Department (CID) of Assam police.
The then Superintendent of Police, Darrang, Raj Mohan Ray has been arrested by CID after collecting evidence that he had taken illegal gratification from the kin of the main accused Krishna Kamal Baruah.
Police stated that the bank account statements of the main accused’s family, the CDR, tower location and Geo Location mapping analyses have been done in detail and after examining all the relevant witnesses, it has come on record that Ray has received an amount of Rs. 2 lakhs from the accused family through the then officer in charge of Dhula Police station for extending undue favours to the main accused of the murder case.
Police stated day to day investigation was conducted under direct supervision of senior officers and adequate evidence have been brought on record to prove the offences of molestation, murder, destruction of evidence, attempt to rape under IPC and sexual assault on a minor child under POCSO Act. During investigation, CID exhumed the dead body, got a second post mortem conducted, consulted a panel of forensic medical experts, conducted the DNA profiling of the main accused which matched with the fluids on the clothes of the victim girl. Accordingly, the detailed charge sheet was filed on 25th September, 2022 against the main accused Krishna Kamal Baruah, who is presently in judicial custody. During further investigation the commissions and omissions committed by the Post Mortem conducting doctors to screen the accused have been brought on record and they were arrested on 7th Nov 2022. Sub Inspector Utpal Borah, was arrested and remanded to judicial custody after custodial interrogation. Even the then Additional SP Rupam Phukan, was also arrested. The other accused Ashirvad Hazarika, the Magistrate whose role has also come on record is absconding.
Sarma said that it is one of rare cases in recent times. Sarma said, “Suicide cases or unnatural deaths cases of last one year be re-visited. In the recent SP’s conference, we have asked similar cases of murder or natural death where cases are closed on the basis of post mortem must be examined.”
He added, “In future in such cases SP and DIG will go to the spot and will not close the case unless satisfied.”
He added, “If a guardian has this type of grievances or feels that it should be further examined one can approach the Superintendent of police. Even cases which happened 15 years back can be approached for there is no time bar in the criminal cases.”
He added, “In this type of case POCSO act is there and IPC is there. However, we will come with SOP and if there are amendments in some laws we will do it.”
